For your convenience, we have included a brief description of the current month's seminar and one subsequent month's seminar. Seminar descriptions will be posted as their respective dates approach.

The BCG Seminar Schedule is approved by a majority of the members of Bankers' Compliance Group®. Scheduling of these seminars is subject to change without further approval. Generally, we expect most of these seminars will run all day in length. An announcement will be sent to all BCG members during the last week of each month regarding the subsequent month's seminars.

TILA/Regulation Z – Closed-end Credit

Regulation Z has undergone significant revisions in the past year, both on the open-end (revolving) credit side and the closed-end (non-revolving) side. In this seminar we will focus on the closed-end credit rules, with a particular emphasis on the amendments that went into effect on July 30 and October 1, 2009. Institutions are still facing issues in complying with these new rules.
The 2009 amendments affected many areas of closed-end lending, including new early Reg Z disclosure rules on most mortgage loans; new Section 35 loans (higher-priced mortgages) and related restrictions; new closed-end advertising rules for dwelling-secured loans; and new rules prohibiting certain practices in connection with dwelling-secured loans.

ROBERT K. OLSEN, ESQ., Mr. Olsen is a principal of Aldrich Bonnefin & Moore, PLC. He associated with the firm in January 1996 and became a shareholder in 1999. Mr. Olsen is head of the firm's Consumer Practice Group. He specializes in consumer regulatory compliance, financial privacy, fair lending and other financial regulatory matters.

JILL C. KOVAR, ESQ., Ms. Kovar joined the law firm in May 2002 as an Associate Attorney in the Consumer Practice Group, with a background in bank operations, regulatory compliance and consumer lending. Prior to joining Aldrich Bonnefin & Moore, Ms. Kovar was employed as both a Law Clerk and a Compliance Consultant with the California Credit Union League from 1998-2002. In addition, she earned certification as a Credit Union Compliance Expert through the Credit Union National Association's professional development program. Ms. Kovar is also a member of the California State Bar Consumer Financial Services Committee. Ms. Kovar's practice focuses on consumer lending compliance, including Regulation Z, Regulation B, RESPA and the Fair Credit Reporting Act.

Legal Processes

Aldrich Bonnefin & Moore, PLC is pleased to invite you and your operations personnel to attend our seminar on the subject of legal processes, specifically, levies and subpoenas. The program will focus on levies served by private creditors as well as governmental agencies. The discussion will include the fundamentals of processing a levy and important principles for determining whether a particular type of account is subject to levy.

We will also cover pending legislation on federal benefit exemptions and both proposed and final California laws on centralized levy processing.

In addition to levies and executions, we will discuss how to respond to requests for financial records. In this area, a portion of the program will be dedicated to both civil subpoenas and government requests for information under the California and Federal Right to Financial Privacy laws.

Loan Participations

In today’s challenging economic environment, a poorly structured loan participation can have adverse consequences for both the lead lender and the participant. As the number of troubled loans grows, participants and lead lenders must work together in determining the best course of action that will maximize the chances of successfully collecting each loan and avoiding losses. Due Diligence: Documenting Your Borrowers

What kind of business is your borrower?

  • Sole Proprietorship?
  • General Partnership?
  • Limited Liability Company?

With the different types of business entities, lenders have challenges
in properly identifying their borrowers and understanding their legal
structures. Customer Identification Program (CIP) rules impose specific
regulatory requirements for identifying borrowers. Failure to identify a
borrower properly may not only impair the lender’s security interest and
put the collectability of the entire loan at risk due to UCC Article 9’s
requirements, but also could result in a compliance violation.

This webinar will address these issues in a “workshop” format
using sample organizational documents to illustrate the types of
information that can be obtained from these documents. Loan
officers, documentation specialists, attorneys and compliance officers
are encouraged to attend.
