As compliance and CRA professionals are well aware, the consumer examination process continues to stress the importance of CRA compliance. CRA examinations evaluate the results of a bank’s lending activities and, for some banks, also their community development investment and services activities, in meeting the credit needs of their local communities. These matters are made all the more confusing with the finalization of the new CRA Final Rule, the first comprehensive update to the CRA regulations in decades that makes significant modifications to how a bank’s CRA performance is going to be evaluated, with new assessment areas and performance tests, revamped definitions of community development, and revised asset-level thresholds for determining whether a bank is a large, intermediate, or small bank.
 
We have designed our CRA Seminar to assist you in understanding today’s rule, now called the “legacy rule” by examiners, as well as key components of the new CRA Final  Rule. We’ll review performance criteria that apply to each type of bank (large, intermediate small, and small), what qualifies as “community development,” and how a bank’s performance context – such as its capacity and constraints and the needs and opportunities within its assessment areas – can impact its CRA performance. Although many provisions of the new CRA Final Rule will not apply until January 2026, we will discuss some important changes that you should be aware of.

There continues to be uncertainty regarding the future of the economy and commercial lenders need to be prepared for the ever changing landscape when it comes to commercial lending and ensure that the lender is adequately protected when making a commercial loan.  With this in mind, Aldrich & Bonnefin, PLC is pleased to invite you to attend our Commercial Lending:  Protecting the Lender Seminar. 
 
This Seminar will focus on a number of important issues impacting the origination and ongoing monitoring of commercial loans, such as due diligence with respect to the borrower and collateral, attachment and perfection of security interests in personal property with a focus on problem areas (and recent significant changes made by Senate Bill 95), as well as managing lending limits and fair lending issues.  The Seminar will also cover issues to consider with regard to loan modifications and various “hot topics” such as an update regarding the status of the CFPB’s small business data collection rule, climate risk issues and recent interesting court cases.

Aldrich & Bonnefin invites you and your operations and compliance staffs to attend a Seminar covering New Accounts Documentation and Compliance. Having proper new account policies and procedures can help financial institutions prevent or at least reduce the risk of fraud and other losses, as well as compliance violations.
 
This Seminar will discuss the documents that institutions will want to review during the account-opening process for individuals, businesses (such as corporations, partnerships and LLCs) and court-appointed fiduciaries (for example, decedent estates, conservatorships and guardianships). There will also be a detailed discussion covering the opening and maintenance of accounts for family trusts.
 
We will include an overview of best practices for opening accounts for non-resident alien depositors, including a review of IRS Forms W-8.
